Cummins & White Trial Team Secures Unanimous Defense Verdict Following Three-Week Employment Trial
Cummins & White recently secured a unanimous defense verdict on every claim following a three-week jury trial in Orange County Superior Court. Attorneys Erick J. Becker and Joshua Park led the defense, supported by paralegal Shannon Thompson.
The case involved a wrongful termination lawsuit brought by a former executive against the firm’s client, a technology and construction company specializing in the development and construction of wireless network solutions.
The plaintiff asserted multiple employment-related claims, including disability discrimination and retaliation under the California Fair Employment and Housing Act (FEHA), failure to provide reasonable accommodation, failure to engage in the interactive process, whistleblower retaliation under California Labor Code section 1102.5, and claims for unpaid wages under the California Labor Code.
Throughout the trial, the defense demonstrated that the employment decisions at issue were based on legitimate business considerations unrelated to any alleged protected characteristic or protected activity. After hearing three weeks of testimony and evidence, the jury returned a unanimous verdict in favor of the defense on every claim.
