Ms. Miglietta holds a LEED AP Building Operations + Maintenance credential through the Green Building Certification Institute (GBCI). This distinction allows her to serve on any construction project whether it is new construction, major remodeling or renovation, and assist the project through the LEED certification process while providing the project with one (1) innovation design credit towards the project’s LEED certification.
Ms. Miglietta also has additional specialized training in Green Building real estate and construction contract provisions, as well as insurance coverage for Green Buildings and unique claims handling issues that can arise under such forms.
Ms. Miglietta joined Cummins & White, LLP as a partner in 2005. She has extensive experience representing insurance companies and their insureds in both first and third party coverage analysis, disputes, litigation, and appeals. She handles all aspects of litigation involving “bad faith,” business disputes, landlord-tenant disputes, and Business & Professions Code §17200 actions.
Ms. Miglietta’s expertise includes handling matters particular to the Southwest and California. She has provided contract analysis on fire policies issued to hundreds of policyholders whose properties were destroyed or damaged in California and Arizona wildfires. She has also represented insurers in complex commercial cases stemming from California earthquakes.
Ms. Miglietta has routinely provided coverage analysis on the duty to defend on wrongful termination, slander and libel, and other personal injury coverage issues in the context of Commercial General Liability, Errors & Omissions, and Directors & Officers policies.
Ms. Miglietta donates her time to coach high school debate and mock trials.
Ms. Miglietta frequently conducts seminars for insurance carriers on the issues of California Fair Claims Settlement Practices Regulations, examinations under oath, concurrent causation, foreclosures and full credit bids and various duty to defend issues including Cumis and various business tort issues. She is fluent in Spanish and Italian and proficient in French.
