Cummins & White, LLP believes that seminars are an effective

general seminars that address timely topics, presenting them
either in-house or at our clients’ offices. We also

Sexual Harassment Training and Education
This seminar provides the required training for employers to comply with AB 1825 passed in September 2004. The new law requires all supervisors to receive at least two hours of training that must include information regarding federal and state sexual harassment laws, harassment prevention and correction, and remedies available to victims. The law applies to all organizations - businesses, government and non-profits - with 50 or more employees. Although AB 1825 only applies to companies with 50 or more employees, it is recommended for all businesses, regardless of size.
Insurance Appraisal: When, How
and Why
This seminar offers a comprehensive approach to appraisals,
describing when appraisal is appropriate, why it benefits
the parties, and how to manage an appraisal from beginning
to end. We illustrate this seminar with case-in-point documents
and hypothetical scenarios to exemplify critical procedures
and key regulations. Recommended for insurance companies,
independent adjustors and insureds.
Arson Losses and Fraudulent Claims:
Legal Procedures and Prevention
This seminar uses actual scenarios to help insurance adjustors
handle and track arson and fraudulent claims, emphasizing
proper legal procedures and prevention tactics. Actual case
scenarios as well as hypothetical claims are analyzed. Following
our “critical steps” process will help ensure
a positive claim outcome. Recommended for insurance companies
and independent adjustors.
Business Torts: Defamation, Invasion
and Trespass
This seminar explores personal injury as it relates to malicious
prosecution, false arrest, imprisonment, wrongful entry, and
oral or written publication of material that slanders or libels
a person or organization, or that violates a persons right
of privacy. This seminar includes the use of hypothetical
scenarios that illustrate the actions that one may or may
not pursue. Recommended for businesses or individuals who
are presented with issues relating to business torts.
Basics of Estate Planning
This seminar offers the fundamentals of estate planning. Our
lawyers will describe the importance and necessity of proper
estate planning, as well as the appropriate vehicles for individual
situations. Our use of examples and current techniques will
demonstrate the basic tools needed to plan for the future
in order to protect participants, their families, and their
assets. Recommended for all individuals who do not have estate
plans.
Fair Claims Settlement Practices
Regulations in California
This seminar offers a general exploration of the California
Fair Claims Settlement Practices Regulations. We address the
duties of the insurer including: the investigation; communications
with the insured and the Department of Insurance; and payment
(or denial) of the claim. We detail the specifics of the California
Insurance Codes that are applicable to the Fair Claims Settlement
Practices Regulations. This seminar offers the necessary training
and certification required each year in order to comply with
the California Code of Regulations. Recommended for insurance
companies and independent adjustors who have claims in California.
Foreclosures and Full Credit Bids
and Their Implications in Insurance Claims
This seminar describes the foreclosure process and the differences
applicable to deeds of trust and mortgages in that process.
Procedures for both foreclosures and full credit bids are
outlined, with key points illustrated by numerous examples
of deeds of trust, notices of default, etc. Recommended for
lenders and companies who issue forced placed and lenders’
insurance.
Fraudulent Theft Claims
This is an interactive seminar, and is presented in four sections.
We describe and analyze issues that commonly arise in fraudulent
theft claims, including various “red flags.” The
seminar covers topics ranging from common policy conditions
to insurance regulations to applicable law relating to fraudulent
insurance claims in the context of homeowners, renters, commercial
and other insurance. Recommended for insurance companies and
independent adjustors.
Insurance Coverage For Business
Torts
This seminar outlines coverage for business torts. We describe
the differences between the duty to defend and the duty to
indemnify, and includes analysis of types of conduct versus
types of injury. Hypothetical examples are used to illustrate
situations that “trigger” coverage in business
torts. Recommended for insurance companies and business insureds.
Insurer’s Duties: Properly
and Safely Documenting Claim Files
This seminar describes in detail the insurer’s obligations
with respect to properly documenting claim files. We use hypothetical
examples to illustrate both liability and property claims
and the types of communication that should take place in order
to properly manage and document the claim. Recommended for
insurance companies.
Real Property Foreclosure Procedures
This seminar outlines the procedures used in real property
foreclosures to provide a general understanding of the process.
It includes a discussion on case authority. We examine the
differences between deeds of trust and mortgages, including
the distinctions between non-judicial foreclosure and judicial
foreclosure. Recommended for landlords, lenders, and companies
who issue forced placed and lenders’ insurance.
Suit Limitation Seminar
This seminar analyzes the suit limitation provision of insurance
policies as a basis for claim denial. Actual case scenarios
and hypothetical situations are analyzed to illustrate the
legal and factual application of the provision to a variety
of claims. The proper claims procedures required in handling
a claim to which the suit limitation provision may apply are
detailed for the attendees. Recommended for insurance companies
and independent adjustors.
Subrogation: When and How to Recover
This seminar offers insight into the area of subrogation.
We present valuable information about recognizing subrogation
potential, preserving the insurer’s rights to recover
following a claim, and the means by which the insurer can
maximize the likelihood and amount of recovery. Recommended
for insurance companies.
